BE WARNED: ABUSING RULES OF ‘KIDS WALKS’ COULD LEAD TO FINES FROM 600 EUROS

The amount of the fine could increase up to 1,500 euros if the time outside with children, is used to meet other parents of other children to chat or share the walk time with, according to Legálitas, based on the Citizen Security Law, and understanding that these fines will go along the same lines as the rest of the penalties for not complying with the restrictions of mobility that have been processed so far.

Thus, the legal services company specifies that the following behaviours could entail a penalty of 601 euros: – going out with children before or after the curfew (the hours allowed are from 9am to 9pm). – going out with a number of children greater than the three allowed. – taking out children older than permitted. – accessing playgrounds. – going more than 1km away from home.
They could also increase the fine, if the walk is made many kilometres away from the house, visiting some peripheral place, or if you are out longer than the allowed one hour.
To estimate these sanctions, Legálitas has based it upon Article 36.6 of the Citizen Security Law, which says: “serious disobedience or resistance to the authority or its agents in the exercise of their functions is considered a serious infraction,” although, it indicates that, according to the General State Advocacy, there must necessarily be an express and individualized requirement by the agent of the authority that is not met, that is, it cannot be automatically classified as an offense.
According to Legálitas’ lawyers, the fines that have already been received by citizens for disobeying the state of alarm, “are usually found in the lowest part of that range, which is, 601 euros.” In any case, they specify that the sanctions depend on the severity of the infraction, but that “an aggravating factor is going out in the company of other people.”
